Thane, May 2 (UNI) The Maharashtra FDA has registered an offense against Amazon for selling abortion drugs online allegedly illegally. FDA Assistant Commissioner Ganesh Rokade said in an official statement here that the Food and Drugs Administration has observed abortion drugs being illegally sold through online portals via the Internet. In order to verify this, the demand for MTP kit without prescription has been registered on the online sales portals. The abortion drug under the brand name A-Kare was found to be available on the online portal amazon.in. The request for the MTP medicine kit was accepted by amazon.in without the required prescription from the registered medical practitioner. The ‘A kare’ Tablet brand MTP kit has been received; however, the drug sales invoice was not received with the courier package. This administration inquired about the sale of the above MTP drug to Amazon Sellers Services Pvt Ltd, they were informed that the drug was being supplied from Orissa. Further investigation based on information provided by Amazon revealed that the drug was not supplied by the seller in Orissa, but the seller’s ID was registered by someone else on Amazon’s online portal. using documents from said pharmacy. The MTP kit is a Schedule H drug under the Medicines and Cosmetics Act 1940 and is only required to be sold on the prescription of a licensed physician. Also, according to the Medical Termination of Pregnancy Act 2002 and its Rules 2003, it is mandatory to use this medicine in a health facility and under the supervision of a service provider. The list of items sold through the amazon.in online portal does not include basic medicines. In this case, Amazon failed to observe due diligence to verify the company/individuals that were registered to sell drugs through their platform. On the online portal amazon.in, the seller has registered the MTP kit for sale under the brand name (A-Kare tablets) without citing the generic name of the drug. Amazon.fr has not ensured compliance with the laws in force for the sale of drugs. Medicines like MTP kit which should not be sold without a doctor’s prescription as it may endanger the health and life of the patient. However Amazon has found to promote the sale of abortion drugs without a prescription. In the above case, the online sale of abortion drugs under the brand name A-Care was carried out in collusion between the seller and amazon.in and was found to be contrary to the provisions of various applicable laws. Hence, the FIR under various sections of the Indian Penal Code 1860 and the Information and Technology Act 2000, read with the relevant section of the Medicines and Cosmetics Act and Rules has been registered on online sales portal amazon.in and others at Kherwadi Police Station, Bandra (East) on 04/29/2022 by Intelligence Branch Officer (Drugs), FDA Headquarters.
